On Wednesday, February 19, the Supreme Court upheld the validity of NEET UG for pursuing MBBS abroad. This decision leaves lakhs of aspirants shocked as it has changed a lot for the students planning to do MBBS from abroad.

NEET Necessary for MBBS Abroad: Supreme Court

Back in 2018, NMC, earlier known as MCI, introduced a new rule that prohibited the MBBS abroad from clearing NEET UG. Many aspirants who had already enrolled in MBBS Abroad challenged this rule in the Supreme Court and asked for a one-year concession allowing them to pursue their course. 

In the recent hearing of this case, the Supreme Court upheld the decision of the Medical Council of India and refused to give the one-year concession. The Supreme Court bench of Justice B. R Gavai and K Vinod Chandran has described the regulation of the Medical Council as fair and transparent.

Now, it will be mandatory for all students who want to take a medical course at any foreign institute to qualify for the NEET UG. 

What Was NMC Regulation for MBBS Abroad

Before 2018, there was a trend that many students were doing MBBS or other medical courses from abroad without passing NEET UG. After this, MCI changed the Eligibility Requirement for Admission to Undergraduate Medical Courses in a Foreign Medical Institution Regulation Act 2002.

The Medical Council of India issued these new regulations in 2018 and 2021 to keep the entire process well organised and improve medical education. After this, it became mandatory for any Indian citizen to pass the National Eligibility Entrance Test for MBBS or its equivalent course from a foreign medical college or institute. According to the new regulation for pursuing the MBBS in abroad are followings:

• He/She shall have to qualify for the National Eligibility cum Entrance Test UG for admission to a foreign institute. 
• According to new regulations, the MBBS course abroad should be at least 54 months.
• The Internships must be at least 12 months in the same medical institution.
• The result of NEET will be valid for 18 months.
• No Transfer of students to foreign institutes will be valid.
• The entire course training and internship should be done in the same foreign medical institution throughout the study. They should not be done in India or any other country from where the primary medical qualification is obtained.
• All the theoretical, practical and clinical training should match the standard of MBBS in India.
• The course should be completed within 10 years of admission.
• To obtain the practice license in, he/she has to qualify for the National Exit Test(NExT)

Regulations are Transparent and Fair: Supreme Court

Challenging the decision of the Medical Council of India, the petitioners told the Supreme Court that these regulations are unconstitutional as they cannot be implemented without amending the Indian Medical Council Act 1956. However, the court said that the Medical Council has the power to issue new regulations as per Section 26 of the Indian Medical Council Act 1956. The bench of Justice B. R Gavai and K Vinod Chandra said, “We find no reason to interface with the regulations. These regulations are fair and transparent and don’t violate any legal provisions.” Along with this, the court also refused a one-time exemption.

The Indian Government recently stated that 7000 MBBS Seats have increased in India this year. This year, the total number of MBBS Seats was 1,15,812, compared to 1,08,940 last year. This increase is relief news for students who are hoping to get admission in MBBS through the NEET UG exam.

60 New MBBS Colleges Are Added

According to government data, 60 new MBBS colleges were opened this year, bringing the total number of MBBS colleges in India to 766. Of these 766 colleges, 343 are private, and 423 are medical colleges.
